CRIMES ACT 1914 SECT 15M
15M On what grounds may a certificate authorising a
controlled operation be given?
On receiving an application that complies with section 15K
or 15L
in relation to a controlled operation, the authorising
officer may give a certificate authorising the operation if
he or she is satisfied that:
- (a)
- the applicant has provided as much information as is
available to the applicant about the nature and
quantity of narcotic goods to which the operation
relates; and
- (b)
- the person targeted by the operation is likely to
commit an offence against section 233B
of the Customs
Act 1901 or an associated offence whether or
not the operation takes place; and
- (c)
- the operation will make it much easier to obtain
evidence that may lead to the prosecution of the
person for such an offence; and
- (d)
- any narcotic goods:
- (i)
- to which the operation relates; and
- (ii)
- that will be in Australia at the end of the
operation;
will be then under the control of an Australian law
enforcement officer.
