(1)

This Part does not apply within the Australian Antarctic Territory or the Territory of Heard Island and McDonald Islands.

(2)

If a person is arrested within the Australian Antarctic Territory or the Territory of Heard Island and McDonald Islands for a Commonwealth offence (including being arrested within the meaning given by subsections 23B(2), (3) and (4)) and is brought, while under arrest, to a State or Territory in which this Part applies, this Part operates in relation to the person as if he or she were lawfully arrested on arrival in the State or Territory.
