CRIMES ACT 1914 SECT 23P
23P Right of foreign national to communicate with consular
office
- (1)
- Subject to section 23L,
if a person under arrest for a Commonwealth offence is not
an Australian citizen, the investigating official holding
the person under arrest must, before starting to question
the person:
- (a)
- inform the person that he or she may communicate
with, or attempt to communicate with, the consular
office of the country of which the person is a
citizen; and
- (b)
- defer the questioning for a reasonable time to allow
the person to make, or attempt to make, the
communication.
- (2)
- Subject to section 23L,
if the person wishes to communicate with a consular
office, the investigating official holding the person
under arrest must, as soon as practicable, give the person
reasonable facilities to do so.
