CRIMES ACT 1914 SECT 81
81 Harbouring spies
- (1)
- Any person who:
- (a)
- intentionally harbours any person whom he knows or
has reasonable ground for supposing to be a spy; or
- (b)
- intentionally permits any persons, whom he knows or
has reasonable ground for supposing to be spies, to
meet or assemble in any premises in his occupation or
under his control; or
- (c)
- having harboured any person whom he knows or has
reasonable ground for supposing to be a spy, or having
permitted any persons whom he knows or has reasonable
ground for supposing to be spies to meet or assemble
in any premises in his occupation or under his
control, refuses to disclose to any authorized officer
any information which it is in his power to give in
relation to that person or those persons;
shall be guilty of an offence.
Penalty: Imprisonment for 7 years.
- (2)
- For the purposes of this section any person who has
committed any offence or is about to commit any offence
against this Part (other than this section) shall be
deemed to be a spy.
- (3)
- In this section, authorized officer means:
- (a)
- a member or special member of the Australian Federal
Police;
- (b)
- an officer of the Defence Force who is in command or
in charge of a prohibited place;
- (c)
- a member of the police force of a State or Territory
who is the principal officer of police in any town or
locality; or
- (d)
- any other person declared by the Attorney-General,
in writing, to be an authorized officer for the
purposes of this section.
